New Live-in Caregiver Law – Effective April 1, 2010

Dear Valued Diamond Clients,

I am writing to personally connect with all of our Diamond Families to share the new reality of the live in caregiver program.   New laws coming into effect April 1st, 2010 will greatly impact your next caregiver hiring decision.

The new law dictates that the employer is responsible for all costs incurred by their nanny to secure a position in Canada inclusive of airfare.  You will also be legally responsible for health insurance and workplace safety insurance.  Overtime must now be compensated reflective of employment standards and will be enforced.  In addition, due to these new laws, placement fees will increase in order to maintain the Diamond standard of service.  Hiring a live in caregiver will be significantly more expensive.  We have been advised by Service Canada that this will not affect our clients who have files now in process.

As a result of changes to the program earlier this year, local live in nannies have become a rare commodity.  In the coming weeks we will be focusing our efforts on the placement of live out nannies until more information on the implementation of the new laws become available.

When the complete information and new contract is available from the government, Diamond will innovate and change our business model to maintain a fully compliant service without compromising our high standards.    We commit to keeping you informed.

As you are aware from previous correspondence from Diamond, we have fought a long battle with the Minister of Labour and Minister of Immigration to prove the unintended negative consequences of the new legislation to employers.  Unfortunately, they did not have the best interests of Canadian Families in mind.

  2. Hello. I would like to find out if you are hiring Filipino nanny/caregiver from Thailand. My sister has a bachelor’s degree in elementary education and is also a certified caregiver from the Philippines. She is currently teaching/residing in Thailand. I would appreciate your promt response.
